Business purpose

Funds must be used for the business, not personal expenses.

Business-purpose financing is extended for commercial use and is treated differently from consumer credit under many laws. The distinction affects which disclosure and protection rules apply; it does not exempt business financing from regulation, and how a given agreement is treated depends on its substance and jurisdiction. Using business funds for personal expenses can breach the agreement.

Worked example

Paying a personal mortgage from a business advance is a breach of a typical business-purpose representation and complicates taxes.
