Settled but unpaid: why the money is late and what post-settlement funding is

You signed the release. The case is over. The check is not here. Post-settlement funding exists for exactly this window. Here is what determines the wait, and how to evaluate an offer by its written payoff schedule rather than by its label.

Why settlement payments are slow

This is not business funding. Legal funding is a consumer product tied to a lawsuit or settlement, and it is priced, regulated, and classified differently from the working-capital products elsewhere on this site. Fast Mula LLC does not fund cases and makes no funding decisions; any inquiry you submit here is kept separate from business funding, and inquiries are not open yet.

  • Release and closing documents: the defendant's insurer will not pay until every signature is in.
  • Insurer processing: internal approvals and check cycles after documents are complete; timing varies by insurer and by any statutory payment deadline in your state.
  • Lien resolution: medical liens, Medicare or Medicaid recovery, and health-insurer subrogation must be resolved and paid from the proceeds before you receive your share. Government-program recovery processes have their own timelines.
  • Court approval: required in some situations (for example, settlements involving minors, some wrongful-death matters, and class or mass-tort settlements), which adds its own scheduling.
  • Structured payouts: some settlements pay over time by design.

What post-settlement funding is

An advance against a settlement that is already signed, repaid from the proceeds when they arrive. The recovery amount is known and the main uncertainty is timing, but a provider’s price is not set by case status alone: it depends on the provider, the contract, lien exposure, and your state. The only reliable comparison is the written total repayment for the same assumed payment date across offers.

Alternatives

  • Ask your attorney for a realistic disbursement timeline and whether a partial disbursement is possible once liens are resolved.
  • Ask whether any interim or partial payment is available in your matter.
  • Negotiate short extensions with creditors using the signed settlement as evidence.
